Types of Surrogacy

• Traditional Surrogacy

Also known as genetic or partial surrogacy, it utilizes the surrogate’s egg, which is artificially inseminated with the intended father’s or donor’s sperm. Therefore, the surrogate is not genetically connected to the child. It is not as common as gestational surrogacy due to legal and emotional complexities. 

• Gestational Surrogacy

In this, the woman(gestational carrier) is not genetically related to the child and carries the pregnancy for the intended parents.  It is executed through the IVF procedure, and an embryo, created using the intended parents’ eggs and sperm, is implanted into the surrogate’s uterus.

• Compensated Surrogacy

In a compensated surrogacy, the surrogate mother is paid more and reimbursed for her medical bills and other expenditures associated with the surrogacy process. This is in exchange for the time and effort she invested in developing the child of another family during the nine months of pregnancy.  Her living expenses, travel expenses, legal fees, and other surrogacy-related expenditures are intended to be covered by this.

• Altruistic Surrogacy

The Surrogacy(Regulation) Act, 2021, bans commercial surrogacy and permits altruistic surrogacy in India. This indicates that aside from pregnancy-related medical costs and insurance, the surrogate mother does not receive any financial compensation. Indian married couples who are experiencing infertility are allowed to do so as long as they fulfil certain requirements and have the required authorisations.

• Compensation Care. Under the current rules, surrogates in India are only eligible for reimbursement for pregnancy-related and medical costs. They are not eligible for a commercial fee. Even so, the surrogate’s physical, nutritional, and psychological needs must be addressed.

• Surrogacy egg donation costs: It is one of the major components of the entire surrogacy budget and can significantly influence the pricing. Donor’s eggs are required when the intended parents do not use their own eggs or are unable to. It causes additional expenses like screening, legal documentation, and compensational costs to the surrogate.

• Surrogacy cost for twins: The cost of the entire package in this case is higher due to increased medical risks, need of better prenatal care, and additional compensation for the surrogate.

Is Surrogacy Legal in Delhi?

Surrogacy is permitted under very specific guidelines in Delhi, India. Only altruistic surrogacy is permitted by the Surrogacy (Regulation) Act, 2021, which went into effect in January 2022. The act prohibits the commercial surrogacy procedure.
