What is Surrogacy?

Surrogacy has become a significant fertility treatment with the advancements in IVF procedures. It allows women who do not have a uterus, have uterine abnormalities that prevent them from becoming pregnant, have severe medical conditions, or have other contraindications for pregnancy, to achieve motherhood. The procedure includes an embryo that they or a donor have created and transferring it to the uterus of a gestational carrier. By creating an embryo using their sperm and donor oocytes, this procedure has also enabled homosexual couples and single men to become fathers.

Types of Surrogacy

  • Traditional

The Surrogacy Act prohibits traditional surrogacy in India. In this kind of surrogacy, the surrogate mother provides the eggs, while the intended father or sperm donor provides the sperm. The child is born using the surrogate’s own eggs. Since the surrogate uses her eggs, she is the biological mother of the child. The biological father of the kid is the intended father if the sperm used for insemination are obtained from him, and if sperm are donated, the child’s biological father is the sperm donor.

Since a surrogate mother will be donating her eggs, she must be evaluated for fertility potential, egg quality, and physical ability to carry the pregnancy to term. The surrogate must be a fit, healthy woman who has no history of terminal illness or certain genetic diseases.

  • Gestational Surrogacy

The first step in gestational surrogacy is choosing a surrogate who consents to bear the child on behalf of the intended parents. It involves fertilising eggs from the intended mother or an egg donor in an IVF lab environment using sperm from the intended father or a sperm donor. The embryo is then placed in the surrogate’s uterus to cause a pregnancy.  The surrogate is not the child’s biological mother, and the two are not genetically linked.

  • Commercial surrogacy

The practice of paying a surrogate mother more than the costs of pregnancy and medical care in exchange for bearing a child on behalf of intended parents is known as commercial surrogacy. To guarantee a safe and moral procedure, surrogates go through extensive medical screening, hormone therapy, and ongoing prenatal monitoring. Even while commercial surrogacy may help those who are infertile or have medical reasons why they cannot conceive, there are serious ethical and legal issues with it.

A few of the important concerns are exploitation, consent, and equal access to care. Due to these concerns, several nations have prohibited commercial surrogacy, including India, through legislation like the Surrogacy (Regulation) Act, 2021, which only allows altruistic surrogacy.

  • Altruistic

Altruistic surrogacy is the term used to describe surrogacy contracts in which the surrogate doesn’t receive financial compensation except for her medical and legal costs. The surrogate is in a close relation to the intended parents in the majority of altruistic surrogacy agreements. Prenatal treatment costs and insurance-related expenses are the only things provided. Altruistic procedures aim to maintain the parental order, save women from exploitation, and prevent the commercialisation of surrogacy.

How is Surrogacy Done?

Before, during, and after the surrogacy procedure.

Before

For a successful surrogacy journey, preparation is essential. Before beginning the procedure, be aware of the following:

  • Consultations: Speak with legal counsel and fertility Specialist.
  • Medical assessment: Blood tests, ultrasounds, and psychological assessments for everyone
  • Legal agreements: Creating agreements that specify duties and obligations.
  • Dietary patterns: Adhering to dietary recommendations suggested by your doctor

During

  • Anaesthesia is sometimes utilised during embryo transfers, but is usually not necessary.
  • The IVF procedure, which typically takes a few days, involves retrieving and fertilising eggs.

Procedure for Embryo Transfer:

  • The surrogate is prepared for the transfer of embryos.
  • One or more embryos are inserted into the uterus using a tiny catheter.

Usually, the process takes half an hour or so.

After

  • Monitoring: The doctor may schedule follow-up appointments with the surrogate to monitor her health and pregnancy status.
  • Pain Management: Over-the-counter pain relief may be recommended if needed.
  • Hospital Stay: Generally, no overnight stay is required unless complications arise.
  • Discharge Instructions: The doctor may provide you with some guidance regarding the activity levels and signs of complications, if any.

When to Consider Surrogacy?

  • Uterine abnormalities that are acquired or congenital
  • Women with unsuccessful reproductive treatments and numerous fibroids
  • Recurrent implantation failure in women
  • The inability to conceive biologically
  • Medical conditions like hysterectomy (uterus removal surgery) and cervical or endometrial cancer
  • Uterus’ absence, such as in Mayer-Rokitansky-Kuster-Hauser syndrome, a condition in which the uterus is absent from birth, or the surgical excision of the uterus, for some medical conditions, such as cervical or endometrial cancer
  • Other medical issues, like heart or renal diseases, make pregnancy risky

How Does Surrogacy Work: Surrogacy Treatment Procedure

  • Select a surrogacy centre

The first and most important step while considering surrogacy is choosing a desired and well-equipped fertility hospital or centre.

  • Choose a surrogate mother

The next step for the aspiring couple is to select a qualified female who is healthy and meets all legal requirements to become a surrogate mother.

  • Sign a legal agreement

The third stage is to sign a formal contract, in accordance with the Indian Surrogacy Bill 2021

  • Retrieve the egg or sperm(donor or self)

During the egg retrieval procedure, an injection is given after 8 to 12 days of medication to facilitate the final maturation of the egg and its release from the follicular wall.

  • IVF (fertilize sperm and egg to create an embryo)

Beginning with ovarian stimulation and concluding with pregnancy tests, the entire IVF procedure is performed by our fertility specialists in the most confidential manner.

  • Place the embryo in the uterus of the surrogate

Following the completion of the fertilisation process, using a tiny tube known as a catheter, embryos are placed into the surrogate mother’s uterus.

  • Confirmation of surrogacy

After the embryo is successfully implanted, the doctor confirms the successful implantation.

  • Routine follow-ups and examinations

The surrogate mother, accompanied by the couple, is supervised for nine months during routine examinations at the fertility centre.

  • Delivery and transfer of the baby to the parents

After the baby is delivered, it is handed over to the couple, as per the signed contract and guidelines.
